This is not to say that a prenup is useless. If carefully drafted and not in violation of public policy or existing law, lawyers say courts may consider it as one of several factors in some cases. But the law does not get overridden by a prenup.
“The first and foremost duty of the court in India is to do justice, and justice as per the law applicable,” said the family lawyer. Prenups can show intent, but they are not enforceable like they are in other places.
Property and divorce laws differ; how assets are divided after divorce in India depends on multiple things:
- The law under which the marriage was registered – Hindu Marriage Act, Special Marriage Act, Muslim personal law, etc.
- The type of assets – ancestral property, self-earned assets, joint accounts
- Circumstances of the separation, including child custody and maintenance needs
Because of this, even couples with a prenup may find that a judge decides differently based on what the law requires.

With changing lifestyles and more conversations around financial independence, many believe India needs a wider public debate on whether prenups should have clearer legal standing.
