Delhi High Court Seeks Police Report Over Attempt to Arrest Accused Despite Court Protection

The Delhi High Court has come down very strongly on judicial limits, seeking explanations from the Delhi Police after an accused person was arrested directly when he was explicitly protected by a formal court order.

The High Court has been scathing of the apparent disregard for an active, legally binding protection order by ground-level officers and has placed the blame squarely at the feet of senior leadership for what it called the procedural lapse.

The Court has ruled that the incident cannot be regarded as a minor administrative lapse and has ordered the concerned Deputy Commissioner of Police (DCP) to intervene personally and file a detailed report.

The High Court has given the police administration a crisp set of questions to answer:

Chain of Command The DCP must provide detailed information as to who made the original proposal for arrest and the chain of command through which the proposal was passed.

The Approval Process: The report should identify which supervising authority gave the final official approval to proceed with the arrest in spite of the active judicial protection.

The Legal Basis: The police must explain the precise legal basis upon which they were required to override a live instruction from the judiciary.

Why this matters The High Court’s intervention highlights an important constitutional check. If a court grants a citizen interim protection or anticipatory bail, the order is an absolute legal bar on arrest. To begin an arrest process regardless means either a dangerous breakdown in communication between the court registry and local police stations or a deliberate disregard for judicial authority.

The whole thing is still under close judicial scrutiny. What happens next in the High Court – whether any individual officers are subjected to stern disciplinary proceedings or contempt of court charges – will be dictated entirely by the findings and transparency in the detailed report submitted by the DCP.
